Welcome to Coltira. These Terms of Service ("Terms") govern your access to and use of the Coltira website, mobile application, and related services (the "Services"). Please read these Terms carefully. By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy.

1. Eligibility and Account Registration

To use certain features of the Services, you must register for an account. By registering, you represent and warrant that you are at least 18 years of age (or the legal age of majority in your jurisdiction) and capable of forming a binding contract. You agree to provide accurate, current, and complete information during the registration process and to keep your account information updated. You are responsible for safeguarding your password and for all activities that occur under your account.

2. User-Generated Content (UGC)

Our Services allow you to post, link, store, share, and otherwise make available certain information, text, graphics, videos, or other material ("Content"). You retain all rights in, and are solely responsible for, the Content you post to Coltira.

By posting Content, you grant Coltira a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform that Content in connection with the provision of the Services.

UGC Guidelines: You agree not to post any Content that:

  • Is unlawful, defamatory, libelous, threatening, pornographic, harassing, hateful, racially or ethnically offensive.
  • Encourages conduct that would be considered a criminal offense or give rise to civil liability.
  • Violates any third party's intellectual property rights or rights of privacy or publicity.
  • Contains malicious code, viruses, or spam.

Coltira reserves the right, but has no obligation, to monitor, review, or remove Content that we determine in our sole discretion violates these Terms or is otherwise objectionable. We operate a zero-tolerance policy for abusive users and strictly enforce content moderation standards.

3. Marketplace Transactions

Coltira provides a platform to connect agricultural buyers and sellers. We do not own, sell, or take possession of the goods listed on the marketplace. Any transaction entered into through the Services is strictly between the buyer and the seller.

Coltira makes no representations or warranties regarding the quality, safety, legality, or descriptions of the items listed. You agree that Coltira is not a party to any transaction and shall not be liable for any disputes, damages, or losses arising out of or in connection with marketplace transactions.

4. AI Advisory Services Disclaimer

Coltira provides AI-driven agricultural advisory features intended for informational and educational purposes only. This information should not be construed as guaranteed professional agronomic advice. Users are encouraged to verify AI-generated insights with local agricultural experts before applying them to commercial farming operations. Coltira assumes no liability for crop failure, financial loss, or property damage resulting from reliance on the advisory features.

5. Intellectual Property Rights

The Services and their original content (excluding User-Generated Content), features, and functionality are and will remain the exclusive property of Coltira and its licensors. The Services are protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Coltira.

6. Termination

We may terminate or suspend your account and bar access to the Services immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms. Upon termination, your right to use the Services will immediately cease.

7. Limitation of Liability

IN NO EVENT SHALL COLTIRA, NOR ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES; (III) ANY CONTENT OBTAINED FROM THE SERVICES; AND (IV) UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

8. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
